The explanatory Memorandum States that the submitted draft is prepared in order to develop the provisions of the Constitution on the Parliament and ensure the necessary volume of legal regulation of parliamentary activity.
MOSCOW, 13 Oct. The leader “Fair Russia” Sergei Mironov submitted to the state Duma a draft Federal constitutional law “On the Federal Assembly of the Russian Federation”.
“The submitted draft Federal constitutional law “On the Federal Assembly of the Russian Federation” prepared in order to develop the provisions of the Constitution on the Parliament and ensure the necessary volume of legal regulation of parliamentary activity”, — stated in the explanatory Memorandum.
The adoption of a law which clearly defines all aspects of the work of the two chambers of Parliament, will align the legal status of the Supreme legislative body in comparison with the higher Executive and judicial branches of the government of the Russian Federation, said the initiator of the document.
Mironov drew attention to the fact that in addition to the Constitution, status and organization of activities of the government and higher judicial bodies — the constitutional court and the Supreme court is determined by relevant Federal constitutional laws and Federal constitutional law on the Federal Assembly has not been adopted to date.
According to the author, the adoption of the law on the Federal Assembly will fill the resulting legal vacuum in the legislative regulation of the activities of the Parliament, will enhance the effectiveness of both chambers and the creation of legal conditions for effective interaction between them.
The adoption of the law will have a positive impact on the status of the 2016 elections to the State Duma, said Mironov.
The draft law establishes the legal basis and basic principles of the Federal Assembly, is determined by its composition, the conduct of chambers and the status of a member of the Council of Federation and the Deputy of the State Duma.
“In addition, the bill establishes the legal framework on activities of the parliamentary opposition. Thus, in particular, establishes that the basis of activity of the parliamentary opposition include the guaranteed right to be represented proportionately on committees and commissions of the State Duma and other bodies of the chamber, the right to a proportional election to leadership positions in the State Duma, and the equal and free access to media, including those established by public authorities”, — stated in the explanatory Memorandum.
However, the document introduces a ban on the adoption of laws in three readings in one day.
A separate Chapter of the bill deals with the powers of the Federal Assembly to exercise parliamentary control, powers in the sphere of personnel policy, safeguards activities of both houses, implement a representative of the powers of the state Duma and the Federation Council, interaction with other state authorities, political parties, public and religious organizations, institutes of civil society.
“Act of Parliament creates the framework of parliamentary law, will provide a holistic regulation is partly scattered at the present time, legal relations related to the organization and activities of Parliament, will clearly define the role of Parliament in the Supreme leadership of the country, will increase the efficiency of interaction of the Federal Assembly with other organs of state, will strengthen the authority of Parliament in the society”, — stated in the explanatory Memorandum.
