The state Duma will consider a question of deprivation of mandates of MPs for failing to declare income


MOSCOW, October 21. The state Duma on Wednesday will consider in the second – mostly-reading amendments which will allow to deprive of mandates of parliamentarians of all levels, as well as municipal officials in elected positions of authority for failure to provide in time – before April 1 – declarations of income.

Initially the initiative was introduced by deputies of United Russia Irina and Sergey Yarovoy Neverova. They proposed to introduce a clear obligation for the members of the Federal Assembly of the Russian Federation and Legislatures of RF subjects to report their income, expenses and property. For non-submission or late submission of declarations was proposed to impose additional liability in the form of early termination of powers.

“This type of responsibility is already provided for opening accounts (deposits), store cash and values in foreign banks located outside the territory of the Russian Federation, owning and (or) use foreign financial instruments,” the authors state in the accompanying documents.

The second reading of the list of elected positions for which tougher indiscipline can be extended. The profile state Duma Committee on constitutional legislation and state construction was supported by the consolidated amendment requiring the deputies of all levels – working on a permanent and non-permanent basis, as well as persons occupying municipal positions, to provide a Declaration, to inform about the presence of conflict of interest and close accounts abroad.

As one of initiators of these changes, the first Deputy head of the LDPR faction Alexei Didenko, introduced new categories – members occupying leadership positions in the representative body Chairman, his deputies, heads of committees and commissions and their deputies. “Now, regardless of whether work for pay or on a voluntary basis, they will be required to declare the income and expenses to close accounts and declare a conflict of interest,” said Didenko.

The same rule applies to heads of administrations of municipal formations, as well as members of territorial election commissions on a regular basis. For “ordinary members” only prescribes the need to declare a conflict of interest. Otherwise, we may raise the issue of divestment.

Deputies of the amendments

Vice-speaker Sergey Neverov said that the party “United Russia” recognize that the adoption of the law will affect, primarily, the representatives of the factions of United Russia. “More than 245 thousand deputies of various level of 165 thousand representatives of “United Russia”. Therefore, when the norm is accepted, we will recommend all our colleagues to eliminate all these legal inconsistencies”, he said.

“I support this initiative, as the deputies of a public nature. If a person comes into the power, then he should be ready to be in a position to comply with all regulations in anti-corruption law”, – underlined Neverov.

The head of the Duma Committee for security and combating corruption Irina Yarovaya said that the provision that the statement of income and property “is imperative”. “It’s not a rule, and the duty of deputies of all levels – provide information about income and expenses. And accordingly it is necessary to establish responsibility,” she said.

According to the Deputy, the analysis showed that for 2013 and 2014 is around 3% of the regional deputies did not submit Declaration on income and expenditure. “We believe this situation is unacceptable,” – said the author of the initiative.

The amendments were necessary

Currently the law specifies that deputies of the state Duma and regional parliaments, as well as members of the Federation Council before April 1, provide information about income and expenses (for the previous year) their spouses and minor children, but the responsibility for their failure and violation of the terms missing.

The need for such legislation arose after this year a number of deputies of legislative Assembly of Chelyabinsk region refused to provide information about their income and expenditure. According to media reports, they referred to the fact that you do not receive a salary in Parliament in the region and therefore do not see the urgency in the publication of the Declaration.

Later in the “United Russia” has monitored the situation and found that their income did not report many MPs in all regions of the Russian Federation. Then Neverov said that the party will review each case and take action against dishonest politicians even before the change in legislation. At the same time he stated that the problem concerns not only the representatives of “United Russia”.
