The company “Transstroy” demands to cancel the contract for the construction of the third runway (runway-3) at the airport “Sheremetyevo” and to recover from the defendant 4.1 billion rubles of losses.

MOSCOW, 2 Nov. The Moscow arbitration court has appointed on December 14, the basic hearings on the case of the engineering Corporation “Transstroy” to Federal Agency of air transport (Rosaviation) from the requirement to terminate the contract for the construction of the third runway (runway-3) at the airport “Sheremetyevo”, which is scheduled to enter to the world football championship 2018, the correspondent from a court hall.

The company is also required to recover from the defendant 4.1 billion rubles of losses. The claim was submitted to arbitration on August 10. Transstroy requests to terminate the state contract No. 64/11 dated 19 December 2011, the repayment terms of the loss of $ 3,197 billion. In addition, the plaintiff demands to recover the cost of the work and costs in the amount of 954,7 million rubles.

At the meeting on Monday, the court brought the case as a third person of FSUE “Administration of civil airports (airfields)”, at the same time, the court rejected the plaintiff’s motion on attracting the savings Bank, which guaranteed the obligations of the contractor to the customer.

“Transstroy” has announced that it has filed a lawsuit in connection with a material breach of the customer — the Federal air transport Agency conditions of contract, which resulted in the impossibility to perform the work within the prescribed period. Thus, as stressed by the contractor, he was ready to complete the contract in time if the customer work out solutions for the rapid completion of the design, the liberation of the territory development and sustainable funding.

The cost of the project — 26,3 billion roubles. Planned construction of about 90 objects, including runway length of 3,200 meters and a width of 60 m, taxiway, bridge construction for taxiing aircraft across the Klyazma river and the Sheremetyevo highway above.

Meanwhile, the Federal air transport Agency has submitted to arbitration of Moscow the claim in which demands to recognise the contract for the construction of R-3 terminated. The Federal air transport Agency in June sent Transstroy notice of his termination. Because the contractor did not agree with the unilateral termination, the Agency appealed to the court.
