The project proposes to amend the town planning code, which establish the conditions of membership and termination of membership in self-regulatory organizations and prohibit the payment of contribution to the compensation Fund of the organization in installments or by third parties.

MOSCOW, 26 Nov. The government of the Russian Federation submitted to the state Duma a draft law on the activities of self-regulatory organizations (SROs) in construction, the order published Thursday on the website of the Cabinet of Ministers.

“The bill proposes to amend the town planning code, specifying conditions of membership and termination of membership in self-regulatory organization and establishing a ban on the payment of the contribution to the compensation Fund of the organization in installments or by third parties”, — stated in the materials by the government.

As reported, the bill introduced by Rostekhnadzor, aimed at improving the quality of performance of works on objects of capital construction, the responsible SROs and their members, control over maintenance of safety and targeted use of their compensation funds, the improvement of the procedure for maintaining the state register of these organizations.

Also, the bill proposes to amend the Code of the Russian Federation about administrative offences in the part of accountability of the SROs and their officers for non-submission or late submission of documents and information, the list of which is established by the legislation of such organisations, for inclusion in the state register SRO or the submission of false information.

It is also proposed to limit the retention period of the files of persons whose membership in the self-regulatory organization terminated, up to ten years from the date of termination of membership in the organization and to bind the organization to approve a procedure for dealing with complaints and appeals against actions (inaction) of members of the organization.

In addition, in order to optimize workflow and avoid duplication of effort provide information about the members of the SRO in the state registry of such organizations and the register of members of the SRO of the relevant Association, the draft law proposes to establish that the information placed in the register of members of the SRO of the respective national Association and also in the register of members of the SRO on its official website.
