Moscow. December 9. To limit the work of the messengers in the territory of the Russian Federation is not planned, only prepared proposals on the regulation of OTT-operators (these include services like instant messengers), said the head of Roskomnadzor Alexander Zharov.
“We are now discussing this matter with the operators, with the competent authorities and prepare a number of proposals that can form the basis of the law (regulating the activities of the messengers)” – he told reporters Wednesday.
“OTT operators must conclude an agreement with the operators and to comply with the limits for operators. The same mass mailing. It’s not just the messengers. These include cinemas, and financial services,” he explained.
He emphasized that further proposals, the Agency is not, as the right of legislative initiative. “Any decisions to restrict the activities of the messengers in the territory of the Russian Federation was not accepted, not accepted and even in sleep we are not dreaming,” said Zharov.
Spam and pseudocertainty
He noted that the problem associated with the activities of instant messaging, there is, in particular, it relates to mass mailings that are in accordance with the communications act completely banned mobile operators.
“It concerns two aspects: one is the user, because the spam is moving from sms to messenger, the second question of state security”, – said Zharov.
He recalled that in November in WhatsApp messenger was made a mass mailing that some terrorists are going to Moscow. “In the end it turned out that all this “duck”, but the negative effect was. Thus, just as we try to suppress the spread of mass mailing from Telecom operators, as it is, I guess, and I was the best but not servers”, – said the head of Roskomnadzor.
He explained that the messengers, as they provide communication services and network operators must sign a contract with them because I use their infrastructure. “They should follow the same legislative restrictions that apply to operators. If mass mailing is prohibited for the operator, and for them too,” said Zharov.
“We, as the Supervisory authority, signal that this topic should be considered. Therefore, generated some proposals that will be submitted to the Ministry of communications, and it will decide”, – said Zharov.
In the Kremlin earlier on Wednesday said that any restrictions for the online instant messengers do not plan to enter. The President’s press Secretary Dmitry Peskov told journalists on Wednesday that the study of the subject is, but it is “not connected to any of the instructions, especially the President’s administration”.
Amendments to the law
As reported in the working group of the Roskomnadzor began discussion of the draft amendments to the laws “On information, Informatization and protection of information” and “About communication” in which the notion of “organized dissemination of information, providing with the use of networks of operators can exchange messages in telecommunication data networks”. This formulation, however, can be attributed to the messengers not only services such as WhatsApp, Skype, Viber, Telegram and etc., but also social networks and other Internet services that allow users to exchange messages.
The authors of the document, a copy of which is on Tuesday read “Interfax”, propose to oblige the messengers working on the contract with operators to identify their users. Such players are also requested to oblige to limit the transmission of spam messages, to ensure the opt-out subscribers from such mailings and to provide the possibility of sending messages at the initiative of the authorities of the Russian Federation.
The project developers also propose to disseminate the messengers, in case of violation of the law, the order of the locks on the model of the locking mechanism Internet sites.
Mobile operators against “parasites”
Mobile operators are not the first year trying to push for the inclusion of OTT services, most of which are foreign players in the Russian legal field.
