Under house arrest has the right to submit the documents for nomination for election by an attorney or under a notarized power of attorney stated in the court order.
MOSCOW, 24 Dec. The constitutional court of the Russian Federation sees no obstacles to the nomination of candidates on elections of people under house arrest, according to the ruling.
In the court complaint asked the associate of opposition leader Alexei Navalny Konstantin Jankauskas, who is under house arrest, could not nominate his candidacy for the Moscow city Duma.
The electoral Commission refused to register yankauskas as a candidate because he is not personally submitted documents to the Commission.
“Standards of laws on electoral rights and the right to participate in the referendum suggest that the documents on the nomination of under house arrest of Mr can be submitted to the election Commission not to them personally, and other persons on the basis of a notarized power of attorney,” — said in the decree.
The court also recalled that under house arrest also has the right to hand over the relevant documents through a lawyer.
