Auchan tried to challenge the fine of 180 thousand rubles imposed by the Federal service for the culinary products shop supermarket were issued the Declaration of conformity of products to requirements of technical regulations.
MOSCOW, 30 Dec. The Moscow arbitration court confirmed legitimacy of the fine of 180 thousand rubles made by the CPS to address major retailer “Auchan” for trade culinary products without certificates of conformity, should of posted on Wednesday a court decision.
The court rejected the statement “Auchan”, demanding to cancel the decision on bringing to administrative responsibility dated 19 August 2015.
The Supervisory authority in June checked the store “Auchan” in Sheremetevsky street in Moscow and found that for products of public catering, prepared in the culinary shop of the hypermarket and sold through the retail trade network, not issued the Declaration of conformity of products to requirements of technical regulations. For this violation provides for a fine for legal entities in the amount from 100 thousand to 300 thousand rubles.
The retailer tried to prove in court that the goods of the culinary Department not subject to the requirements of technical regulations in this part, because it belongs to the category of food products whose production is carried out by the organizations of public catering in the course of rendering of services of public catering for consumption at the place of production.
However, the court these arguments were rejected, finding that Auchan is a hypermarket and sells food from their own production through self-service, while at the catering and cooking service is provided by the seller. In addition, the payment of food products “Auchan” takes place directly at the POS at the output, thus, it cannot be consumed on the spot, said the court.
Chief sanitary doctor Anna Popova in October stated that the test network “Auchan” territorial departments of Rospotrebnadzor carried out as planned, check in Moscow is completed. Inspection of the network “Auchan” is held by the CPS since the end of July in connection with the discovery in the pork mince contaminants of chicken meat and cattle.
