The Moscow arbitration court rejected an application from a large retailer LLC “Auchan”, demanding to declare illegal a fine of 100 thousand rubles, imposed on him by the Federal service for selling chargers without indicating the date of manufacture of the product, follows from the published decision of the court.
The CPS in June checked the store “Auchan” in the Vavilova street in Moscow and found that the implemented network charger Samsung d800 & mini usb, there is no mandatory information about the date of manufacture of the goods. This is a violation of article 5 Technical regulations of the Customs Union “On safety of low voltage equipment”.
The court heard the case in the simplified procedure, without conducting trial. In his statement, “Auchan” referred to the fact that such goods do not fall under the technical regulation, since both the output voltage lies in the range up to 50 volts, and therefore, they do not apply to low voltage equipment.
The court, however, agreed with the arguments stated in the review of the CPS in a statement. The court stated that to low voltage equipment is electrical equipment intended for use at rated voltage from 50 to 1000 volts AC and 75 to 1500 volts DC. Technical characteristics of the charging devices provided for their work at the input voltage 100-260 volts, according to the court decision.
The court found the seller guilty of an administrative offense is proven, the resolution on bringing him to administrative responsibility is lawful.
Earlier it became known about the inspections of shops “Auchan” in Moscow, who conducted the CPS and the Rosselkhoznadzor. The head of Rospotrebnadzor Anna Popova 15 September 2015 reported that following the inspection of the Moscow shops “Auchan” the total amount of fines exceeded 25 million rubles. The Rosselkhoznadzor, in turn, said that the retailer artificially extends the shelf life of chilled meat by manipulating the marks in the process of its storage.
