Aeroflot initially demanded to collect with “Transaero” a large sum, but later refused requirements about collecting of the penalty for misuse of loan funds.
MOSCOW, 25 Jan. The Moscow arbitration court under the claim of “Aeroflot” has decided to collect from airline “Transaero”, which started bankruptcy procedure, about 2.9 billion rubles, the correspondent from a court hall.
In this lawsuit the largest Russian air carrier initially demanded that “Transaero” more than 2.7 billion rubles principal debt under the loan agreement from October 1, 2015, more than 274 million roubles, 62,5 million roubles of fines and 57.7 per million percent, but later the requirement about collecting of the penalty for misuse of the borrowed funds is refused.
Transaero, in turn, has stated a counterclaim for invalidity of the loan agreement. As explained by the representative of “Transaero” in court, at the time of conclusion of the contract the General Director of “Transaero” Dmitry Saprykin was also a member of the Board of Directors of “Aeroflot”, therefore, according to Transaero, this deal is for both parties was a transaction with interest, demanded approval of the Board of Directors, but such approval is not received. The court dismissed the counterclaim.
