Gryzlov: special status of Donbass should wear a permanent Foundation “formula of Staumauer”


MINSK, 27 January. Plenipotentiary representative of Russia in the contact group on Ukraine, Boris Gryzlov on Wednesday held a meeting in Minsk announced the negotiating position of the Russian delegation.

Also, according to Gryzlov, “the editors of these amendments to the law on the special status should be agreed in the contact group”.

“We need to find a legal formula to ensure that the paragraph 18 of the Transitional provisions of the Constitution will be sent to the current wording of articles 2 to 9 of the law on the special status and agreed to re-contact group on the revision of articles 1 and 10”, – said the representative of the Russian Federation. He pointed out that this formula should be enshrined in the Constitution of Ukraine.

“It is also necessary to legally enshrine in the Constitution of Ukraine that the authority elected at the elections in Donbas on the law of individual persons will not be discontinued in 2017, as foreseen in the constitutional reform for the whole of Ukraine”, – said Gryzlov.

The adoption of the permanent legislation of Ukraine on the special status of Donbass, including by making appropriate amendments to the Constitution of the country, is one of the fundamental requirements of the principles of peaceful settlement agreed in Minsk leaders “channel four”.

In August last year, the Verkhovna Rada adopted in the first reading amendments to the Constitution. In its transitional provisions were made paragraph 18, which States that the characteristics of local government in certain districts of Donetsk and Lugansk regions “are defined by a separate law” .

In paragraph 18 does not specify what law of Ukraine regulates these features, and the item is temporary in nature, as it refers to the transitional provisions of the Constitution.

In principle, in September 2014 the Verkhovna Rada adopted the law on local self-government in certain districts of Donetsk and Lugansk regions. But then it introduced fundamental amendments. As a result, according to the 1st article of the law, the validity of the special status in the Donbass is limited in duration to three years. And 10 article suspends the action of article 2-9, in which in fact describes the special status of Donbass, until the holding of new elections and the formation of new governments.

In other words, all the constitutional reform in Ukraine, as required by the Minsk agreement, in fact was frozen. The representatives of Donbas have repeatedly stated that Kiev all the proposed changes are of a unilateral nature, and therefore cannot be approved.

Announced today, Boris Gryzlov, the position of the Russian delegation in fact intended to get out of this situation on a consistent basis.

Earlier, German foreign Minister Frank-Walter Steinmeier said about the need for a special law on elections in the Donbass, that is not a General of the Ukrainian election law and regulations, site-specific and to a specific situation. In this case, the law should consolidate the special status of the region according to the formula: “In the day of the elections in the Donbass on a temporary basis, and since the publication of the OSCE report on the election results – on a constant”.

 

Russia’s position on the negotiations of the contact group

1. The vote on the Constitution of Ukraine should be closely linked with the simultaneous adoption of the amendments to articles 1 and 10 of the law on the special status of Donbass to give a special status to the permanent bases “formula Steinmeier”.

2. The editors of these amendments to the law on the special status should be agreed in the contact group.

3. Need to find a legal formula to ensure that the paragraph 18 of the transitional provisions of the Constitution will be sent to the current wording of articles 2 to 9 of the law on the special status and agreed to re-contact group on the revision of articles 1 and 10.

4. This formula should be enshrined in the Constitution of Ukraine.

5. You must also formalize in the Constitution of Ukraine that the authority elected at the elections in Donbas on the law of individual persons will not be discontinued in 2017, as foreseen in the constitutional reform for Ukraine.
