MOSCOW, 1 February. The Chairman of the state Duma Sergey Naryshkin has denied the opinion that in Russia there is a revision of the constitutional norms on the rule of international law.
At the meeting with young scientists of the Moscow state legal University named O. E. Kutafin one expert cited the views of the Chairman of the Investigative Committee Alexander Bastrykin that the revision of paragraph 4 of article 15 of the Constitution went.
“I have these traits not found”, – said Naryshkin.
According to paragraph 4 of article 15 of the RF Constitution, generally recognized principles and norms of international law and international treaties of the Russian Federation are a constituent part of its legal system. If the international Treaty of the Russian Federation establishes other rules, than provided by law, the rules of the international Treaty.
The head of the Investigative Committee of Russia Alexander Bastrykin in February 2015 has proposed to exclude from the Constitution the primacy of international law over Russian law. “The Constitution was a provision on the unconditional priority of international law over national law… it Seems that the removal of these, figuratively speaking, “sabotage of legal regulation” will strengthen the independence of the Russian Federation in the legal field, it will return to the best traditions of domestic justice,” said Bastrykin.
