ST. PETERSBURG, February 2. /Corr. Roman Podervyansky/. Arbitration court of the North-West district (NWB) found lawful the situation with restriction of sales of metro tokens in St. Petersburg at the end of 2014. It follows from the materials of a card file of Affairs.
Arbitration district court considered the cassation appeal of metro on the decision of Arbitration court of Petersburg and Leningrad region from July 14, 2015 and the ruling of the 13th arbitration court of appeal dated 21 October 2015. Two of these vessels were previously left in force the decision of the regional Rospotrebnadzor about attraction to administrative responsibility of the Metropolitan for the sale of a token in one hand.
In the end, the Arbitration court of the North-West had ruled that the annulment of the regulations of the office of Rospotrebnadzor from February 19, 2015. According to the decision, he is found to be inconsistent with the provisions of the law “On protection of consumer rights”. Cancelled also the decision and decree of the courts hearing the case previously.
Management Rospotrebnadzor prescribed “to eliminate the violations of the rights and legitimate interests of the” enterprise “St. Petersburg metro”, is spoken in court definition. Also management decided to collect in favor of the underground of 3 thousand roubles of court costs on payment of state duty for the consideration of the case by the court of first instance.
The verdict, which made the Arbitration court, Northwest district, may be appealed.
Restrictions on the sale of tokens for travel on the subway at some stations of the Petersburg subway was introduced in late 2014 due to excessive demand. It was caused by a rise in price from 1 January 2015 tokens from 28 to 31 of the ruble. In the new year’s week in the metro residents of St. Petersburg were first sold by two tokens in hand, and later only one.
After that, many citizens filed complaints to the FAS and the Prosecutor’s office. Last December 26, 2014 start checking, but its results came to the conclusion that the restriction was a necessary measure. The office of the Federal service for supervision of consumer rights protection and human welfare (Rospotrebnadzor) in St. Petersburg issued in February a ruling that metro was contested in the arbitration.
