“Anticollection” the law of the Penza deputies submitted to the Duma


MOSCOW, February 17. Legislative Assembly of the Penza region, in the Duma introduced a bill prohibiting the collection activities. The document is published on Wednesday in the electronic database of the lower house.

The draft amendments to the Federal law “On consumer credit (loan)” proposes that the “creditor is not entitled to an assignment of rights (claims) under the agreement of a consumer loan (loan) to third parties, except for assignment of rights (claims) of one credit institution to another credit institution with the consent of the debtor, expressed in writing”.

The bill also provides that a legal person with whom the lender concluded an Agency agreement aimed at committing such person to repay the debt should only be a credit institution.

In the explanatory note of the Penza deputies have noted that existing legal standards regulating the activities of collection agencies are ineffective, because of what violations of the rights of citizens, including children. Earlier it was reported that the Commission to develop antikollektorskie the law and send it to the state Duma was given by the Governor of the Penza region Ivan Belozertsev.

Recently in Russia there have been many abuses by collectors. The most resonant was the case on 27 January in Ulyanovsk, where the window of a private house, presumably the collector was thrown a bottle with flammable liquid. As a result, the owner of the house and his two year old grandson suffered burns.

Earlier in the Duma was introduced several bills governing the work of collectors. At the end of January it was reported that deputies of the state Duma have confirmed the possibility of the early adoption of the law on collection activity – either in one version, proposed by parliamentarians, either in the wording of the Ministry of economic development, which has long been preparing this initiative. The future instrument should eliminate the possibility of repetition of recent tragic incidents involving the activities of collectors, said in the state Duma. The Federation Council speaker Valentina Matviyenko has previously advocated to suspend the activities of collection agencies prior to the adoption of the law on their activities.
