MOSCOW, March 3. The owner of the rides at ENEA in Moscow Vladimir Gnezdilov challenged action of the Moscow Department of the Federal service of bailiffs, whose staff began work on forced demolition of amusement. He said this to journalists.
“Just from the prosecution. Filed a statement of the offence under article 284 (Civil code of the Russian Federation “the Withdrawal of the land plot that is not used in accordance with its designated purpose”. -). The Ostankino Prosecutor’s office filed a complaint about the crime,” said Gnezdilov.
Also, according to him, the termination of the sublease of the land on which houses rides, between JSC VDNH and joint-stock company “the Russian exhibition of attractions” has been appealed to the Supreme court. “Not over yet no judicial process,” he added.
In turn, the chief of Interdistrict Department for special enforcement proceedings of non-property character of the Federal service of bailiffs for Moscow Alexander Zuikov stressed that the bailiffs are not appealed in court.
“On appeal I don’t know. No suspension of enforcement proceedings there. The bailiffs have every legitimate reason to enforce court order (dismantling the rides),” said Zuykov.
On Thursday, 3 March, in persuance of the decision of Arbitration court of Moscow about the liberation of the land occupied by ZAO “Russian exhibition of attractions”, which entered into force on 22 September, at ENEA work began on preparing the site for dismantling the rides.
As previously reported in the capital Department of the Federal bailiff service, will be demolished in just 12 rides. Among them, the Ferris wheel, “panic Room”, chained carousel, “Mini-jet”, “Northern lights – M”, “Tropicana”, “Mary go round”, swing “Mars-306”, etc.
“The debtor, JSC “Russian exhibition of attractions” in a given voluntary implementation period of the decision of Arbitration court of Moscow to release the land plot on the territory of VDNKH is not performed, therefore the bailiffs will be made compulsory execution of a court decision”, – said earlier in the bailiff system.
