Austria refused to extradite to Russia the former head of “Bashneft”


Moscow. March 9. A court in Austria refused to authorize the extradition to Russia the former head of “Bashneft” Ural Rakhimov, one of the defendants in the criminal case on the illegal sale of shares of the company, the lawyer said Rakhimov Sergey Makarenko on Wednesday.

“The court has not found legal grounds for the extradition, declared the extradition is unacceptable,” – said Makarenko.

According to him, the decision taken by the court back on February 19, and it is, to the knowledge of the advocate, not to appeal.

The lawyer believes that repeated requests for extradition Rakhimov is only possible when representing the Austrian side additional grounds and arguments.

The case about illegal sale of shares of “Bashneft” was initiated in April 2014. In August on the sale of shares of Bastakia Sistema was brought another criminal case under article about legalisation of money acquired through criminal activity. The defendants in the case were the Ural Rakhimov, businessman Levon Hayrapetyan and the head of Sistema Vladimir Yevtushenkov.

Rakhimov in absentia charged under article 160 and article 174.1 of the criminal code (misappropriation or embezzlement and legalization of funds acquired through criminal activity). He declared in the international wanted list after Moscow Basmanny court in absentia arrested him.

In December 2014 the attorney Rakhimov Ayrat Latypov said that his client had left Russia five years ago, when no criminal proceedings have not been initiated, and never returned, but investigators know that at present he is in Austria.

The Russian side has sent to Austria a request for extradition Rakhimov.

Sistema bought shares of “Bashneft” of the funds, which were close to the then head of the Republic Murtaza Rakhimov and his son Rakhimov.

In October 2014, the Moscow Arbitration court has established that the privatization of Bashneft was held with violations, and decided to claim the shares of the oil company. In December, the AFC gave Bashneft to the state, and in February, 2015 via the court recovered to 70.7 billion roubles from “Ural-invest” – the seller of the asset, structures close to Rakhimov.

In March, the parties entered into the settlement agreement: “Ural-invest” paid “System” of 46.5 billion, and she pledged to invest 4.6 billion rubles from the money received to charitable projects of the Fund “Ural” (owns 100% of “Ural-invest”).
