The state Duma will not adopt a new version of the code of administrative offences (Cao) in the last session of the current convocation. The authors of the project have left it for consideration to deputies of the new convocation, which will be selected in September 2016. About it journalists were told by one of the authors of the document, the Chairman of the Duma Committee on constitutional legislation and state construction Vladimir Pligin.
The reason for the postponement of the discussion of new legislation for six months was a protracted discussion between the authors of the Cao and departments and concerned institutions. According to pligina, before the deputies had the goal of “not meeting deadlines”, and deeper professional task. Given the continuing discussion, the authors of the new code decided not to make a hasty document, it needs to be verified, professional and not to wear conjectural character, explained Pligin. He noted that there was a large number of comments on the document, but all of the panellists support the concept of the project and the need for the adoption of the new code. The problem with the adoption of the document exclusively in a professional discussion and not related to other aspects, said the Russian.
The new administrative code is discussed in the legislature, the business community and officials for several months. In late October, the first edition of this document was published for public comment in December, a draft code submitted to the state Duma a group of deputies headed by Mr Pligin and head of the faction United Russia Vladimir Vasiliev. Acting Cao for more than 10 years, he was accepted in 2002, and during that time much has changed — there are new legal institutes, such as institutes of public procurement, the contract system, and legally institutionalized institutions in the sphere of state control (supervision), wrote the authors of the bill in the explanatory Memorandum.
According to the authors of the project, the state Duma should start consideration of the draft after discussing it with all stakeholders.
Criticism of the new code were made by the representatives of all business communities, the Commissioner for the rights of the businessman Boris Titov, representatives of RSPP and OPORA Russia. The business community was strongly criticized especially such of his novels as a new kind of punishment in the form of liquidation of the legal entity, the significant increase of fines, unclear division of offences with severe, significant and less significant.
From late January to mid-February, the constitutional Committee held a hastily around 20 meetings of working groups for detailed discussion of the amendments to the document with the participation of relevant agencies. In early February, Pligin said that the Committee could consider the draft at the meeting in the end of the month. March 2 was the final meeting with participation of Chairman of the state Duma Sergey Naryshkin. The speaker pointed out that the Council should conduct a thorough analysis of all proposals submitted to the new edition of the code.
According to pligina, now for the new Duma, they will prepare and document revision for the second reading. It should be ready by mid-may, promised the Chairman of the Committee.
