“Kalashnikov” sued by relatives of the designer right to the brand name AK-47

The IP court decided to satisfy the claim of the Russian concern “Kalashnikov” to ZAO “M. T. Kalashnikov”, which is owned by the daughter and grandson of Mikhail Kalashnikov the designer of a database of court cases.

The reason for the suit was the use by the company of the brand with a volumetric image of the machine and the verbal element of the AK-47. The group demanded from the Respondent to prematurely terminate the legal protection of a trademark in Russia.

The lawsuit was filed in the court on 16 June 2014.

From the data of Rospatent showed that the brand was registered at CJSC “M. T. Kalashnikov” in 2004. At the end of 2012 legal protection of the brand has been extended until 2022. It spread on clothing, hats, as well as slot machines and table games.

CJSC “M. T. Kalashnikov” was founded in 1999. The founder was himself Mikhail Kalashnikov and his daughter Elena Kalashnikova and her grandson Igor Krasnovsky. For this company the designer himself and his heirs has registered a number of trademarks related to the name Kalashnikov.

Concern “Kalashnikov” (formerly NGO “Izhmash”) is the largest Russian manufacturer of combat automatic and sniper weapons, guided artillery shells, as well as a wide range of civil products. The concern produces hunting rifles, sporting rifles, machines and tools. The company was founded in 1807. The parent structure of the group is “rostec”.

Legendary designer Mikhail Kalashnikov died in Izhevsk in December 2013. He died at the age of 94.
