The government approved stricter requirements to the participants of public procurement


The government approved the bill a number of measures to prevent and suppress “kickback” in public procurement. By order of the government the document will be sent to the state Duma, according to the website of the Cabinet.

The bill, developed by the Ministry of labour, it is proposed to amend the law on procurement No. 44-FZ “in uniform requirements for procurement participants”.

In particular, according to the bill, the party purchasing must not have been convicted for crimes in the economic sphere, as well as crimes provided by item 289 (illegal participation in enterprise activity), item 290 (bribe taking), article 291 (bribery), 291 (intermediation in bribery) of the criminal code. The exceptions are those who have the criminal record expunged.

In addition, the document suggests that the party purchasing may not be a physical face to which was applied a punishment of deprivation of the right to occupy certain positions or engage in certain activities that are associated with the supply of goods, performance of works, rendering of services, or administrative punishment in the form of disqualification.

Also, as the project, a prerequisite is that a procurement participant (legal entity) not previously brought to administrative responsibility for committing an administrative offense under article 19.28 of the administrative code (illegal remuneration on behalf of a legal entity).
