In it, in particular, it is noted that the amendments Mizulina does not take into account the fact that the change in article 116 was aimed at “early detection and combating domestic violence, illegal behaviour of the parents and other persons likely to commit violent acts against loved ones.” Explanatory Memorandum to the bill does not contain statistical or other evidence needed of the proposed changes stated in the draft opinion.

The bill on the decriminalization of family beatings, prepared Mizulina, was submitted to the Duma this summer. The Senator has proposed to exclude criminal liability for “assault against close persons” without causing harm and to attribute these acts to administrative law.

As explained by the author of the amendments, had previously been decriminalized article 116 of the criminal code (assault). Under the changes, the offender is criminal liability will be a penalty if the offence is committed for the first time, not in relation to close relatives and not from hooligan promptings, and if it was compensated for the damage.

According to Mizulina, the new edition contains “a number of controversial, anti-family provisions” due to the fact that “criminal responsibility for the beating without harm to health are released all but close relatives”. In the end, “for a slap in the family can receive up to two years and branded a felon for life, for beating on the street — the penalty to 40 thousand rubles”. “This situation is unacceptable!”, – said Mizulina.
