In the state Duma started thinking about legislative protection of works of art


The head of the Duma Committee on culture Stanislav Govorukhin made several “legislative initiatives on the issue of moral constraints in art and protection from vandalism against works of art”, writes in Thursday newspaper “Kommersant”.

The Committee told the publication that these initiatives the Committee could consider as early as Thursday, September 17.

Select Govorukhin initiatives – amendments to the Criminal code (CC) and the Code of administrative offences (Cao) on additional measures of responsibility for the desecration of cultural sites.

In particular, he proposes to discuss the expansion of the criminal code article 214 (vandalism), especially adapting it to the specifics of culture. So, for “the desecration, damage or destruction of” works of art in the event of significant harm, it is proposed to punish by a fine in the amount from 100 thousand to 1 million rubles, correctional labor for up to one year or deprivation of liberty up to two years.

In the code proposes to introduce a new article — “Public desecration of the works of literature, art or folk art”. For such an offence it is proposed to penalize citizens in the amount of 50-100 thousand rubles., to be punished by compulsory works for a term of up to 120 hours or imprisonment for up to 15 days. When re-offence proposed to be punished with a fine from 100 thousand to 500 thousand rubles, compulsory works for up to 200 hours or arrest.

Separately to the Cao, the Deputy suggests to enter penalties for citizens and officials for “obstructing public execution (displaying) works of literature, art or folk art during a theatrical entertainment, educational or entertainment events, public screening of the film”. For the first such violation, the proposed fine of 50-100 thousand RUB, works up to 120 hours or imprisonment for up to 15 days, for officials the penalty from 100 thousand to 200 thousand rubles.

According to the newspaper, Govorukhin initiatives were a response including the actions of the activists, forcing the closure of the controversial exhibitions. Speech, in particular, about the exhibition of Jock Sturges in the Center of photography behalf of the Lumiere brothers.

In early November, Govorukhin criticized the idea on the inspection of the film by Alexei Uchitel “Matilda” about Nicholas II and the ballerina Mathilde Kshesinskaia. Commenting on this step, Govorukhin said that such initiatives need to “break root”.
