The government refused to lift the ban on entry into Russia of people with HIV

The Ministry of health against MIA

The project plan for the implementation of the state strategy of counteraction to human immunodeficiency virus (HIV), calculated until 2020, the Ministry of health handed over to the government on January 19. In the document, a copy of which is at , the office of the prescribed items for the gradual implementation of the strategy. Among other things, the Ministry made proposals to combat discrimination against infected. Before sending to the Cabinet of Ministers, this section has been edited, found , after reviewing the previous version of the plan and observations with nearly two dozen stakeholder agencies.

Initially, to combat discrimination, the Ministry of health raised questions about the removal of restrictions for infected people to enter and stay in Russia, adoption and military service. The need for HIV-infected people to serve in the army or in one of the departments in question were subjected. But the point about the lifting of restrictions on entry, exit and residence in Russia of foreign citizens, the Ministry of health as a result of the plan was eliminated at the insistence of colleagues in other ministries.

Against this point was made by the economic development Ministry and the interior Ministry. State Secretary, Deputy Minister of economic development Oleg Fomichev suggested that this fight against discrimination against infected could threaten the national security of the state “in protecting the health of the population.” According to authorities, Russia, on the contrary, needs to be better tested for HIV entering the country to foreigners. The Deputy Minister of internal Affairs Alexander Maganov reminded the health Ministry that the interior Ministry was asked to give up that initiative back in the summer of 2016.

Now in Russia can enter only those foreigners with HIV whose spouses, children and parents are citizens of the country or reside on its territory. Such a right infected patients received from the beginning of 2016. The reason for the easing of the legislation was the decision of the constitutional court on 12 March 2015. The applicants in this case were two Ukrainians and a resident of Moldova. A Ukrainian citizen, was deported from the country after discovering he was HIV positive, despite his marriage to a Russian woman. The second citizen of Ukraine with the infection are unable to return to the civil husband and the child after leaving the Ukraine and a woman from Moldova refused to issue the temporary residence permit, in spite of husband and child with Russian citizenship. The court found this behavior migration authorities unconstitutional.

20 Oct 2016 was declared unconstitutional a ban on the return to Russia of citizens who completely recovered from dangerous diseases, such as tuberculosis. Amendments to the legislation in this regard, a solution is being developed.

A ban on the adoption

The economic development Ministry has questioned the need for the abolition of the ban for people with HIV to adopt children. In Department have noticed that this item is not correlated with the strategy, but to insist on its no exception. The Ministry of health, the initiative was maintained.

Has undergone a major revision and the item about the HIV dissidents. HIV-dissidents — people who deny that AIDS is caused by immunodeficiency virus. Some of the members of the movement deny the very existence of HIV. The Ministry of health was planning to introduce responsibility for spreading false and dangerous to the health of citizens information about the virus. It was opposed by the Ministry of justice. In the comments, the Agency stated: Mnust there is no evidence that the actions of the HIV dissidents are massive. In the end, the Ministry of health proposed to prevent the dissemination of information only appeals to refuse from treatment of the infection.

Another key change that has undergone the draft plan — the refusal of additional funding strategies 70 billion RUB due to the observations of the Treasury plan no longer provides for the allocation of additional funds to combat the infection. In the feasibility study of the project, officials point out that to Finance the implementation of the plan should be the Agency responsible for its implementation, as well as regions.

Some of the initiatives departments are not reflected in the latest version of the plan. The Ministry of health did not add to the supply side, the Federal Antimonopoly service of the withdrawal of pharmaceutical companies exclusive rights to manufacture and sell patented drugs, if they urgently need to lower the price, and priority registration of HIV medicines in the event of an epidemic.

The decision about the final version of the plan will be in the government. The discussion document is planned for January 31. The strategy of combating infection was approved on 20 October 2016.
