The government at the request of the assistant withdrew from the Duma 15 bills

The filter of the first reading

The government withdrew in April 15 of their legislation and suggested that the Duma reject the seven initiatives proposed in previous convocations of the Duma. So the Cabinet has responded to the request of the speaker of the Duma Vyacheslav Volodin to audit the bills. The speaker at the end of February indicated the representative of the government in the lower house Alexander Sinenko the need to get rid of outdated laws.

A recommendation to revoke or reject an abbreviated procedure for projects that have lost relevance, were made by a working group which was preparing proposals for the reduction of bills under consideration. To get rid of old bills also asked the Duma committees and fractions. An audit was to take place within two months.

All withdrawn by government projects have not passed the first reading. They were copied by the government and discussed in different wording, or taken in the parliamentary wording, or met resistance in the Duma and will not be accepted as proposed.

Irrelevant

The initiative to use increased rate of land tax on agricultural land not used for agricultural production, lost its relevance, after it was adopted by the parliamentary bill and also the withdrawal of these land plots in the case of misuse.

Against a bill to increase from 5.1 to 5.9% rate of insurance contributions to the Federal compulsory medical insurance Fund (FOMS) from 2019 previously made by the deputies of the Duma Committee on the budget, and the faction “United Russia”, considering it to be unfounded. After negotiations with the deputies of the officials, an agreement was reached that the government will not insist on the adoption of this bill.

The government withdrew the project on the reduction of the minimum administrative fine for NCOs — foreign agents are not included in the relevant register, from 300 thousand to 100 thousand rubles., the Document was prepared pursuant to decisions of the constitutional court.

The bill was irrelevant a few months after entering into the state Duma — by the time there was approved the governmental document, which has enabled the courts in some articles of the Code of administrative offences to reduce the fine to two times less than the lower limit, said Deputy Chairman of the Committee on legislation Rafael Mardanshin.

15 withdrawn by the government of the four projects concern the regulation of the supply of steel pipes of Ukrainian origin on the territory of Russia, Belarus and Kazakhstan. They were made in 2012 and 2013.

Between the first and second

Seven government projects that passed the first reading, but has not been considered in the second, was proposed to be rejected. They have the seventh Duma of the previous convocation.

Among them are the projects on improvement of the procedures applied in business about bankruptcy of the strategic organizations. In the case of its adoption by the possibility of bankruptcy mechanism in relation to strategic organizations will be significantly reduced, noted the Duma Committee on property. In 2011 he was accepted in the first reading, then the Duma it has not returned.

“There are bills that have been adopted in the first reading, but in the process of finalizing the second reading of the concept of government has changed. It was considered impolite to reject them: when reject government bills adopted in the first reading, for all ministries is a minus,” — said the first Deputy Chairman of the Committee on budget and taxes Sergey Katasonov. According to first Deputy Chairman of the legislation Committee Mikhail Emelyanov, the bill “stalled” between the first and second readings, when confronting the lobbying interests of separate departments.

The sixth part

According to estimates , the government selected 22 projects constitute approximately one sixth of the number of “stale” in the Duma draft laws initiated by the Cabinet of Ministers. Approximately 140 projects were submitted by the Cabinet of Ministers in previous convocations of the Duma and did not reach consideration in the second reading, although, typically, government projects are considered as a priority.

Were, for example, in the Duma portfolio of resonance a bill to transfer to the Moscow authorities the powers to conduct the Affairs of traffic violations recorded by video cameras. The document was prepared pursuant to the instructions of the first Deputy Prime Minister Igor Shuvalov tabled in may 2015, but considered by the Duma was not.

Selected by the Cabinet 22 of the bill is “a drop in the bucket,” said Emelyanov. “The government just shrugged, complied with the order formally” — I agree MP from the Communist party Valery Rashkin.

The tasks of the working group, who offered to audit the bills, was not to assess how much and what bills need to withdraw and reject, said the head of the group, the first Vice-speaker of the Duma Ivan Melnikov (CPRF). “The group was set only those filter criteria bills: loss of relevance, the isolation from the real situation from a legal point of view and life”, — said the Deputy.

Old practice

The government from time to time, withdraws the bills that become obsolete and lose their relevance, says political analyst Ekaterina Shulman. “The government is also working on the news agenda: something happened — paid project, but if every day comes up with new ideas, the old at the same rate outdated, so from time to time they take them,” she says.

Thus, according to Shulman, it is necessary to consider that the government has the right of legislative initiative as a collective body, so to reject your projects you need to reach a consensus between the agencies that has been made in their introduction, but it is not always easy.

Each new Chairman of the Duma begins with what promises to dismantle the legislative blockages, says the analyst. According to her, is demonstrative guidance discipline, because the old laws don’t interfere with anybody: there is no rule that old needs to be rejected before new to consider. “If you want to be a more important authority than the Duma of the previous convocation, the obvious first step is to bring discipline in. But the true test of your hardware and political weight — is the ability to communicate on an equal footing with the government,” concludes the analyst.
