The CEC ruled that the relevant law is a question of the Communist party in the post-referendum

MOSCOW, July 27. /TASS/. The CEC has recognized not corresponding to the requirements of the law the wording of the question, which the Communist party proposes to put to a nationwide referendum against raising the retirement age, because of the uncertainty of the issue, which, in the opinion of the Commission, may introduce people astray. The decision of the CEC adopted at the meeting on Friday.

Of the 13 attending the meeting of the CEC members voted for 11 people, against one (the representative of the Communist party Eugene Kolyushin), another – Nikolay Levichev abstained.

The Communists have proposed to submit to referendum the question “do you Agree that in Russia the age of eligibility for appointment of insurance old-age pension must not be increased?”.

“Explicit uncertainty”

As explained by the Secretary of the CEC, Maya Grishina, “citizens need to have special knowledge to understand the contents of this issue.” Also, the CEC concluded that “the wording of the question can be participants in the referendum in confusion about the legal consequences of the expression of the corresponding position, admits possibility of its multiple interpretations that ultimately will not provide identification of the actual will of the people of the Russian Federation”.

In conclusion, the CEC stated that the wording “the age of eligibility for appointment of insurance old-age pension” does not contain any features that would specify it for the referendum. It “refers to the lack of reference to specific ages, and to the absence of specific in the matter of pension”, is written in the document.

“In particular, it creates an obvious uncertainty as to the content proposed by the initiators of the issue in the event of changes in its legal regulation in the course of the initiative referendum”, – stated in the conclusion of the CEC.

Grishina said that “legislation may change during the voting you may find that citizens vote for the regulation, which exists on the day of the referendum”. That is explained to the member of the Central electoral Siyabshah shapiev, by the time the referendum, the law on pension changes, providing for increase of retirement age, has already come into force.

Thus, the proposed for the referendum question “does not meet the requirements of part 7 of article 6 of the Federal constitutional law “On referendum of the Russian Federation,” reads the decision of the CEC. Grishin explained that in accordance with this article, the referendum question was phrased so as to exclude the possibility of its multiple interpretations and uncertainty of legal consequences of the referendum decision, and that this question could only give a definite answer.

The rules of the referendum

For the organization of a nationwide referendum is required to hold a meeting of the initial subgroups of no less than 100 people, more than half of subjects of the Russian Federation (i.e. at least 43). After successful registration of the subgroups in 43 regions held a meeting of their commissioners, subsequently, the Commission served a petition for registration of initiative group on referendum. In the case of a positive decision within 45 days of the initiative group must collect at least 2 million signatures, one region may have no more than 50 thousand signatures.

Moscow became the first region where the Communist party held a meeting of the regional initiative of the subgroup, then the application was filed in the Moscow city election Commission. According to the law the electoral Commission shall send to the CEC the wording of the referendum question, and the office within 10 days to decide whether it meets the requirements of the Federal constitutional law “On referendum of the Russian Federation”.

A national referendum was not carried out in Russia since 1993.

Pension bill

The proposed government bill on changes in the pension system, involving, in particular, increasing the age of retirement for a long transition period to 65 years for men and 63 years for women, passed the first reading in the state Duma on July 19. After approval of a large-scale discussion of the initiative will continue, proposals for revision of the draft law will be collected and recorded in the form of amendments to the second reading, which will take place in the fall. The deadline for submitting amendments is extended from August 18 to September 24.

Tools that will increase the retirement age, will be directed on increase of incomes of pensioners, assure of the government. The adoption of the document will allow in 2019 to ensure the growth of pensions to pensioners by an average of 1 thousand rubles.
