MOSCOW, October 20. The arbitration court of St. Petersburg and the Leningrad region refused to accept the Declaration of bankruptcy of airline “Transaero”, which was lodged by Sberbank on October 16.
It follows from the materials published on the court’s website.
The court explained its refusal by the fact that the Bank did not fulfill the condition of preliminary notification (not less than 15 calendar days) of airline “Transaero” about their intentions.
“Under such circumstances the arbitration court considers that at the time of applying to the arbitration court at the credit institution has no right to appeal to court with the statement for bankruptcy “Transaero” in connection with what is believed possible in relation to article 43 of the “Law on bankruptcy” to refuse its acceptance”, – stated in the materials of the court.
It is noted that the savings Bank may file an appeal with the Thirteenth court of arbitration within a period not exceeding 14 days.
