According to the explanation the authors of the bill, the introduction of criminal liability will help to prevent violations of the legislation on premiums.
MOSCOW, 12 Nov. The government of the Russian Federation submitted to the state Duma a bill introducing criminal liability for non-payment of premiums, indicated in the database of the lower house of Parliament.
According to the law on compulsory social insurance against accidents at work and occupational diseases, the insured bears responsibility for default or inadequate execution of obligations on timely registration as an insurer from the insurer, timely and full payment of insurance premiums, timely submission to the insurer of the established reporting, as well as for the timely and full payment by the insurer of insurance payments of the insured.
Thus, it is proposed to add that the attraction not only to administrative responsibility, as it is now, but criminal for violations of this law shall be in accordance with the code of administrative offences and the criminal code.
In addition the bill also amends the police act, under which this Agency’s responsibility to forward the materials to the tax organ or the body of control over payment of insurance premiums for taking decisions in identifying the circumstances requiring such action of the tax authorities.
The bill takes into account the mechanism of participation of internal Affairs agencies in on-site audits by the tax authorities, as well as the relationship between tax authorities, internal Affairs bodies and investigative bodies, stipulated by the current Tax code.
The draft law complies with the provisions of the Treaty on the Eurasian economic Union, as well as provisions of other international agreements of the Russian Federation.
