The COP can give right recognition unfeasible solutions international court of justice


Amendments to the law “On the constitutional Court of the Russian Federation” can enter into force before the end of December 2015. The bill provides a mechanism for resolving the question of the possibility or impossibility of execution of judgments of various judicial authorities against Russia.

MOSCOW, 1 Dec. In the Federation Council supported the bill, which gives the Constitutional court the right to declare impossible the carrying out of decisions of international courts, and believe that the document can come into force before the end of December.

“Our Committee will support the law under consideration in the Federation Council, we are confident that by the end of the autumn session of this year the bill will be passed and approved by the houses of Parliament”, — told reporters one of the authors of the bill, the Chairman of the constitutional Committee of the Federation Council Andrey Klishas.

The state Duma on Tuesday adopted in the first reading the bill, which gives the Constitutional court the right to recognize the impossible execution in the country of decisions of international courts, if they violate the supremacy of the Constitution.

Amendments to the law “On the constitutional Court of the Russian Federation” provide for a special legal mechanism for the resolution of the question of the possibility or impossibility of execution of judgments of various judicial authorities against the Russian Federation, said Klishas.

“We are grateful to the colleagues from the state Duma for the prompt consideration of the bill,” said Klishas.

Earlier, the Senator said that the bill if adopted could be extended to the decision of the Hague court in the Yukos against Russia in case the corresponding request to the COP to appeal to the authorized body.
