MOSCOW, January 14. The Ministry of economic development has developed a draft decree on the rules of exemptions from the sanctions list for Turkish companies. The document is available on the official portal of projects of normative-legal acts.
The draft regulation includes the rules of selection of contracts to companies under the Turkish jurisdiction and to companies controlled by Turkish nationals, in respect of which are ineffective the sanctions imposed by the decree of the President of the Russian Federation.
Selection criteria
In the regulations prescribed the criteria by which contracts will be admitted to the selection. To qualify for exclusion from the list of contracts, if in respect of goods and services they ban or restriction on the territory of the Russian Federation.
Sanctions will not apply to contracts, if the inability to sign a will affect the performance of the internal or external obligations of the Russian Federation or organizations. This rule applies if there is no possibility to replace the goods and services of contract from other sources or replacement will lead to disproportionately high costs.
Exemptions will apply in respect of contracts which affect the interests of the security of the Russian Federation, a significant number of consumers if replacement. Economic measures do not apply to the contract if the impossibility of their conclusions will cause significant difficulties in the implementation of economic, technical, financial, innovative programs of the Russian Federation and subjects of the Russian Federation.
The procedure
The selection of contracts will be dealt with by the government Subcommission on customs-tariff regulation and non-tariff regulation and protective measures in foreign trade and by the interdepartmental Commission at the MAYOR.
To participate in the selection process of the Russian company should submit to the MAYOR two months before the alleged contract with the Turkish organization of relevant documents. The Commission and sub-Commission within 30 days of taking the decision on inclusion in the list of exemptions or refusal.
The decision on inclusion of the contract in the list of exemptions is made by order of the government.
Sberbank and other
Earlier, first Deputy Minister of economic development Alexei Likhachev reported that Sberbank and several large companies have approached the MAYOR with a request to include them in the list of exemptions by the sanctions of Russia against Turkey.
Likhachev said the list may include dozens of companies.
Sanctions against Turkey
As previously reported, the Russian government has approved a list of certain types of work, prohibit from 1 January 2016 for implementation by organizations under the jurisdiction of Turkey, as well as organizations controlled by the Turkish citizens and (or) the organisations under the jurisdiction of Turkey.

The list includes construction of buildings, engineering structures and specialized construction works; activities in the field of architecture and engineering, technical testing, research and analysis; activities of travel agencies and other organizations providing services in the field of tourism; activity of hotels and other places for temporary accommodation; performance of works, rendering of services for state and municipal needs; processing of wood.
The document was submitted to the government pursuant to the decree of the President of Russia from November 28, 2015 “On measures for safeguarding national security of the Russian Federation and the protection of citizens from criminal and other unlawful acts and on application of special economic measures against the Turkish Republic.”
Relations between Russia and Turkey
The crisis in relations between Moscow and Ankara has arisen in connection with the incident on November 24 in the skies over Syria near the border with Turkey.
