MOSCOW, January 15. /Corr. Tatiana Vinogradova/. The Russian government proposes to significantly increase the fines for employers for non-payment of salaries to its employees. The bill was approved Friday at a meeting of the government of the Russian Federation, reported the press service of the Ministry reported.

The increase in penalties

“Compared with the existing fines in case of first violation the increased fine for non-payment of wages only for officers. It will be from 10 to 20 thousand rubles (currently – from 1 to 5 thousand roubles). At repeated violation the fine for officials increases with 10-20 thousand 20 to 30 thousand (in addition, there is an alternative penalty in the form of disqualification for a period from 1 to 3 years),” – said the press service.

For entrepreneurs without legal entity and legal entities in case of repeated violation increases only the upper limit of fines, the lower bound does not change. For this category of entrepreneurs, the fine is now 10 to 20 thousand roubles, it is suggested 10-30 thousand rubles. For legal entities the fine is set at 50-70 thousand rubles, it is suggested to 50-100 thousand rubles.

“In accordance with the draft law it is planned to increase only the upper bound of penalty and only the second violation for legal persons up to 100 thousand rubles, the minimum fine will not increase. In the case of primary violations increased penalty for non-payment of wages only for officials. Such fines we proposed, based on the proportionality of the sanctions stipulated by law for similar offenses”, – the press service quoted the words of the Minister of labour Maxim Topilin.

According to the Minister, the proposed increase in penalties are primarily aimed at the prevention of repeated violations.

To specify the date

In addition, it is proposed to specify the date of payment of wages not later than 10 days from the date of expiry of the period for which it is accrued. Now the salary should be charged to the employee not less frequently than every two weeks. This certainty is needed to prevent delays by employers and claims Supervisory authorities, explained in the Ministry of labor.

The Statute of limitations for appeal to the court for protection of violated right wage is proposed to increase to one year instead of the current three months. And also be granted the right of filing a claim on labor disputes at the place of residence of the employee.

Statistics of wage arrears

Debts to employees on wages is not reduced, said the Ministry. According to Rosstat, as of 1 December 2015, according to organizations unrelated to small business, the total wage arrears in a circle observed economic activities amounted to 3.9 billion rubles. Compared to November 1, 2015 debt increased by 395 million (11.3 %). Compared to December 1, 2014 the debt has grown by 1.5 billion (60.8 %).
