PNP: the new law protects the notary’s Deposit from a Bank


“The Deposit of the notary for the settlement of transactions, e.g. purchase of real estate is becoming more popular. Now the notary’s Deposit, which acted as a convenient, inexpensive and secure method of payment on the transaction, is secured from such a threat, as the bankruptcy of the Bank”, — stated in a press release.

MOSCOW, 19 Jan./strong>. Recent changes in Russian legislation give consumers of notarial services additional guarantees of reliability when using the so-called “notary’s Deposit”, the report said the Federal chamber of notaries (PNP).

The President of Russia Vladimir Putin on December 29 signed a law No. 391-FZ “On amendments to certain legislative acts of the Russian Federation”. A number of the changes made by law changes applies to notarial acts and notaries public.

“The Deposit of the notary for the settlement of transactions, e.g. purchase of real estate is becoming more popular. In addition to safety and convenience compared to the archaic practice of using a Bank of cells, the Deposit of a notary is even more favorable from a financial point of view. Now the notary’s Deposit, which acted as a convenient, inexpensive and secure method of payment on the transaction, is secured from such a threat, as the bankruptcy of the Bank”, — stated in a press release.

Earlier in the revocation of the license of the Bank where there was a notary’s Deposit, which had been client tools, for example, to calculate the transaction of purchase and sale of an apartment, the buyer had to solve the problem of “frozen” money, as by law he is the owner of these funds.

Under the new law, funds deposited in the notary’s Deposit in the event of termination of the Bank, removed from the bankruptcy estate. After joining the Bank bankruptcy Trustee the money that was on Deposit account of a notary, will be immediately transferred to the notary who, in turn, will transmit them to the owner of these funds is explained in the PNP.
