Domodedovsky city court of Moscow region on Thursday, March 24, refused to consider the complaint of lawyers of the actual owner of Domodedovo Dmitry Kamenshchik on the initiation of proceedings against their client. The lawyers demanded to recognize the illegal involvement of the owner of the airport as a defendant in a terrorism case. This position was supported by the representative of the Prosecutor General.
The representative of the investigation and the lawyers of the victims from the terrorist attack during the meeting, demanded to refer the case to the Basmanny court earlier sanctioned the arrest of Kamenshchik and other defendants. The Domodedovo city court judge agreed that the claim of the accused should consider the Basmanny court.
“The complaint is subject to consideration by the court in whose jurisdiction is the investigating authority”, — is spoken in the resolution of the Domodedovo city court.
On the meeting of the Domodedovo city court it became known the day before. This was reported by lawyer Igor Trunov representing interests of victims of the terrorist attack. Earlier all meetings were held in the Basmanny court at the location of the Investigative Committee of Russia (TFR) — or the higher Moscow city court.
This time the defense tried to appeal the decision of the TFR in the Domodedovo city court. As explained by the lawyer Kamenshchik Michael Kolpakov, article 125 of the code of criminal procedure allows to submit complaints on such cases in the district court at the place of Commission of the alleged offence (Domodedovo airport).
Kamenshchik and three other defendants in the criminal case is charged with violating part 3 of article 238 of the RF criminal code (rendering services not meeting requirements of safety, entailed on imprudence death of two and more persons). The maximum punishment — imprisonment up to ten years.
Similar charges brought against a former Director of the airport Vyacheslav Nekrasov complex, ex-managing Director of aviation security, and Andrei Danilov, the former head of the Russian branch of the company “the Airport management company Ltd” Svetlana Trichinae. The first two are in custody, the latter under house arrest until 28 April.
According to investigators, in 2010, the representatives of Domodedovo has implemented a new control system included in the building of passengers, which reduced the level of security, 24 January 2011 a suicide bomber Magomed Yevloyev entered freely in the airport and blew himself in the crowd. Then, 37 people were killed, 170 were wounded.
