Prime Minister Dmitry Medvedev signed a government resolution On the procedure for compensation of actual damage tourists from the Fund personal liability of tour operators in outbound tourism”. The document published on the website of the Cabinet of Ministers.
As stated in the explanatory Memorandum, the decision aims to provide “consumer protection” in the field of outbound tourism and the establishment of an effective mechanism of compensation of actual damage to the tourists.
Was previously adopted Federal law 49-FZ, which provides for the formation of the Fund the personal responsibility of tour operators to charge for any damages incurred as a result of default by operator of its obligations. Medvedev signed the decree determines the order of these payments. “The rules define the persons entitled to present claims for compensation of actual damage until the actual date of departure in the country of temporary stay indicated in the agreement on sale of tourism product”, — stated in the explanatory Memorandum.
The Association of tour operators 90 days to register the tourists who have suffered real damage. After that within 10 working days should be considered the complaints of the tourists and decided on compensation of the damage. Within three days after the decision on indemnifying the Association of tour operators tourist guides written notification.
If the funds accumulated in the Fund of tour operators, not enough for satisfaction of all requirements, the payments are reduced and made proportional to the claimed amount of damages.
