The Russian Association for electronic communications (RAEC) sent a letter to the speaker of the state Duma Vyacheslav Volodin criticized the proposals of the Minister of culture Vladimir Medinsky about defend Russian cinema, write “Vedomosti”.
Medinsky has proposed to simplify the procedure for the blocking of sites with pirated content and allow them to block without a court order.
“Extrajudicial procedure is dangerous because the decision is made by an administrative body, which unlike a court, is not independent. Also in process is not involved, the site owner: he could not exercise their constitutional right to protection”, — the newspaper quoted the letter to RUSK.
The authors of the letter also pointed out that the initiative of the Ministry of culture sets a dangerous precedent, since an extrajudicial procedure proposed to be applied to economic disputes, not to protect the rights and freedoms of a person or the security of the state.
In RUSK felt that if the amendments of the Ministry of culture will be supported by, other market participants, citing the constitutional principle of equality of all before the law, can also require the introduction of extrajudicial procedures to protect their rights.
